Poughkeepsie good cause eviction rules protect many renters, because the City of Poughkeepsie opted in to New York’s Good Cause Eviction Law. Under poughkeepsie good cause eviction, a renewal increase of up to 8.38% is presumed reasonable under the state notice first posted July 16, 2026.
Is Your Unit Covered by Poughkeepsie Good Cause Eviction?
The Attorney General’s April 2025 list names Poughkeepsie as an opt-in city. DHCR’s 2026 notice goes further. It lists both the City of Poughkeepsie and the Town of Poughkeepsie as opted in as of May 4, 2026. As a result, poughkeepsie good cause eviction protections reach renters in both places.
However, some units are left out. The biggest exemption is the small landlord. In the City of Poughkeepsie, a small landlord owns no more than one unit anywhere in New York State. A landlord also cannot hide behind an LLC. If any person behind the LLC owns more than the limit, you are still covered. Other exemptions include:
| Rule | What it says | Where it comes from |
|---|---|---|
| Small landlord | Exempt if the landlord owns no more than 1 unit anywhere in NY | DHCR Good Cause notice, 2026 |
| High rent | Exempt if rent is above 345% of HUD fair market rent | DHCR Good Cause notice, 2026 |
| Newer buildings | Exempt if the certificate of occupancy was issued on or after January 1, 2009 | NY Attorney General guide |
| Owner-occupied | Exempt if the owner lives there and the building has 10 or fewer units | NY Attorney General guide |
| Other exemptions | Rent-regulated, income-restricted, condo or co-op units, and sublets | NY Attorney General guide |
For example, Poughkeepsie is in Dutchess County. There, HUD’s fair market rent is $1,364 for a studio and $1,979 for a two-bedroom. We multiplied those by 345%. That puts the high-rent line at about $4,706 for a studio and about $6,828 for a two-bedroom. Please confirm your exact limit with NYS Homes and Community Renewal.
Each opted-in city sets its own limits. Here is how the poughkeepsie good cause eviction limits compare with a few other places, from DHCR’s 2026 notice:
| Locality | High-rent exemption | Small landlord means |
|---|---|---|
| City of Poughkeepsie | 345% of fair market rent | No more than 1 unit in NY |
| City of Kingston | 300% of fair market rent | No more than 1 unit in NY |
| City of Rochester | 245% of fair market rent | No more than 1 unit in NY |
| Village of Catskill | 275% of fair market rent | No more than 1 unit in NY |
| City of White Plains | 345% of fair market rent | No more than 4 units in NY |
How Much Rent Can Go Up Under Poughkeepsie Good Cause Eviction
Under state law, an increase is presumed unreasonable if it is above 5% plus inflation. It is also presumed unreasonable if it is above 10%. The lower of the two limits applies. Dutchess County uses the New York-Newark-Jersey City price index. DHCR reports that index rose 3.38% from 2024 to 2025.
So for poughkeepsie good cause eviction purposes, the local rent standard is 5% + 3.38% = 8.38%. That figure comes from DHCR’s notice first posted July 16, 2026. DHCR must publish new figures on or before August 1 each year. In most cases, 8.38% applies until the next notice, expected by August 1, 2027. For example, on $1,500 rent, 8.38% is $125.70. A new rent above $1,625.70 would be presumed unreasonable.
However, the landlord can ask a court to allow more. A judge must look at property taxes. The judge may also look at fuel, insurance, and maintenance, and at major repairs to structural, electrical, or plumbing systems. The official sources say nothing about banking unused increases. Since August 18, 2024, every lease, renewal, and legal notice must say whether your unit is covered under poughkeepsie good cause eviction, and if not, why.
Eviction Protections in This City
Under poughkeepsie good cause eviction, your lease ending is not enough. The landlord must prove a good reason. Those reasons include unpaid rent (unless caused by an unreasonable increase) and lease violations. Nuisance behavior counts too. So do illegal occupancy, refusing access, illegal use, owner move-in, and demolition. Taking the unit off the rental market, or refusing a reasonable renewal offer, can also count.
Owner move-in has limits. The owner or a close relative must truly plan to live there, and no other suitable unit can be vacant. If you are 65 or older or disabled, the landlord cannot evict you for owner move-in. The official sources list no relocation payment. However, if a landlord lied about moving in, demolishing, or leaving the rental market, you can sue for money and attorney’s fees.
Renewal offers must also come on time. The landlord must offer a renewal 30, 60, or 90 days before your lease ends. The number depends on how long you have lived there. Typically, poughkeepsie good cause eviction also bars renewal offers with an unreasonable increase or with big new terms, like a sudden no-pets rule.
What to Do If Your Landlord Breaks the Rule
The official sources name no Poughkeepsie rent board. In most cases, you use poughkeepsie good cause eviction as a defense in eviction court. You can also report a landlord to the NY Attorney General’s hotline at 1-800-771-7755. The line for deaf and hard-of-hearing callers is 1-800-788-9898. The Attorney General’s Good Cause guide explains your rights.
Gather your papers first. Bring your lease, any renewal offer, and rent receipts. Also bring notices, texts, and photos. If your landlord claims to be a small landlord, you can ask the court for “discovery.” Discovery forces the landlord to show who owns the LLC and what else they own.

Frequently Asked Questions
Does poughkeepsie good cause eviction cover the Town of Poughkeepsie too?
Yes. DHCR’s 2026 notice lists the Town of Poughkeepsie as opted in, separately from the city. The town uses the same 345% high-rent limit and one-unit small landlord rule.
Can my landlord refuse to renew my lease just because it ended?
In most cases, no. Under poughkeepsie good cause eviction, the landlord needs a good reason, such as unpaid rent or a lease violation. Check with your court or a local legal-aid office about your situation.
Is an increase above 8.38% automatically illegal?
Not automatically. It is presumed unreasonable, but the landlord can try to justify it in court with taxes or repair costs. You may be able to refuse it and still keep your home.
Protect your stuff while you sort this out
A landlord’s insurance does not cover your belongings — renters insurance does, often for a few dollars a month. Compare options before your next move.
