Oakland rent control is real, and it covers many older apartments in the city. Under oakland rent control, the city’s Rent Adjustment Program (RAP) sets one yearly cap on increases, tied to inflation. The last rate we could confirm on the city’s website is 0.8% for August 1, 2025 through July 31, 2026. We could not confirm the rate for August 1, 2026 through July 31, 2027 from an official city source. Before you pay any new increase, ask RAP for the current number.
Is Your Unit Covered by Oakland Rent Control?
Start with the year your building was built. In most cases, oakland rent control applies to multifamily buildings built before January 1, 1983. For example, a 1960s fourplex in Fruitvale is typically covered. However, a building finished in 1990 is not covered by the rent cap.
Some rentals are left out of the rent cap. Rented single-family homes and condos typically are not covered. Tenants who pay with a Section 8 voucher or another rent subsidy are also left out. However, eviction protection is broader. Oakland’s Just Cause for Eviction Ordinance covers most units built more than 10 years ago. That includes rented houses and condos. As a result, you may have eviction protection even without oakland rent control on your rent.

How Much Rent Can Go Up Under Oakland Rent Control
The yearly cap under oakland rent control follows inflation. The city bases it on consumer price data for the San Francisco Bay Area. Each new rate starts August 1 and runs through July 31. For August 1, 2025 through July 31, 2026, the rate was 0.8%. For example, on a $2,000 rent, that allowed an increase of $16 a month. The city page for the period starting August 1, 2026 did not load for us. Check the city’s allowable rent increase page for the current rate.
In some cases, a landlord may add increases they skipped in past years. This is called “banking.” Landlords may also ask RAP for more money for big repairs or higher costs. However, those extra increases have limits. Some also need RAP approval first. If your notice goes above the yearly rate, ask the landlord how they got that number. Then check with RAP before you pay it.
Your landlord must give you the official “Notice to Tenants of the Residential Rent Adjustment Program” (the RAP Notice). California also has a statewide rent cap. However, for units under oakland rent control, the local rules are what usually matter. Ask RAP which rule applies to your unit.
Eviction Protections in This City
Oakland’s Just Cause for Eviction Ordinance lists ten legal reasons to evict. Your landlord must name one of them. Selling the building is not a just cause. Changing the unit’s status is not one either. Neither is the end of your lease. As a result, a landlord typically cannot evict you just because your lease ran out.
Some evictions are “no-fault.” For example, an owner may want to move in. In those cases, Oakland’s Uniform Relocation Ordinance may require the owner to pay you. From July 1, 2025 through June 30, 2026, the city listed $8,106.68 for a studio or one-bedroom. It listed $9,977.45 for a two-bedroom and $12,315.92 for three or more bedrooms. Some households could get an extra $2,500. That included lower-income, elderly, or disabled tenants, or families with children. These amounts change every year. Confirm the current amounts with RAP before you agree to move.
What to Do If Your Landlord Breaks Oakland Rent Control Rules
Your main tool under oakland rent control is a tenant petition. You file it with the Rent Adjustment Program. You can use it to challenge a rent increase. You can also ask for lower rent if services were cut or the unit has code problems. You can file online or on a paper form.
Bring your lease and every rent increase notice. Also bring rent receipts or bank records and any RAP Notice you got. Photos of repair problems help too. After you file, you must serve a full copy of the petition on the owner. You must also send the “Notice to Property Owner of Tenant Petition.” Then file a Proof of Service with RAP. Your petition is not complete without it.
